2. Use License

  1. VisiTel grants permission to temporarily download one copy of website materials, including information or software, for personal, noncommercial, temporary viewing only. This is a license, not a transfer of ownership. Under this license, you may not:
    1. Modify or copy the materials;

    5. Transfer the materials to another person or mirror the materials on another server.
  2. This license automatically terminates if you violate any of these restrictions and may be terminated by VisiTel at any time. When your use of the materials or this license ends, you must destroy downloaded materials in your possession, whether in electronic or printed form.

3. Disclaimer

Materials provided through the VisiTel website and applications are provided on an “as is” basis. VisiTel makes no express or implied warranties and disclaims all other warranties, including implied warranties or conditions of merchantability, fitness for a particular purpose, and noninfringement of intellectual property or other rights.

VisiTel does not warrant or make representations regarding the accuracy, likely results, or reliability of materials provided through its website or applications, or materials available through websites linked from VisiTel services.

4. Limitations of Liability

To the extent permitted by law, VisiTel and its suppliers will not be liable for damages arising from the use of, or inability to use, materials on the VisiTel website or applications. This includes, without limitation, damages arising from loss of data, loss of profit, or business interruption, even if VisiTel or an authorized VisiTel representative has been advised of the possibility of such damages.

Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages. Therefore, some of these limitations may not apply to you.

5. Revisions and Errors

Materials appearing on the VisiTel website or applications may contain technical, typographical, or photographic errors. VisiTel does not warrant that materials are accurate, complete, or current. VisiTel may change the materials at any time without notice but does not commit to updating them.

6. Third-Party Links

VisiTel has not reviewed every website linked from its website or applications and is not responsible for the contents of linked websites. The inclusion of a link does not imply endorsement by VisiTel. Your use of a linked website or application is at your own risk.

7. Changes to These Terms

VisiTel may revise these Terms and Conditions of Use at any time without notice. By continuing to use the website or applications, you agree to be bound by the version of the terms then in effect.

8. Governing Law

Claims relating to the VisiTel website or applications will be governed by the laws of the State of Texas, without regard to its conflict-of-law provisions.

9. SMS and Mobile Messaging Terms

By providing your mobile telephone number and opting in to receive text messages from VisiTel, you agree to the following terms:

  • Consent: You authorize VisiTel to send automated and manually initiated text messages to the mobile number you provide. Messages may include appointment reminders, account alerts, and support updates. Consent is not a condition of purchase.
  • Message frequency: Message frequency varies based on your use of VisiTel services and your account settings.
  • Opting out: You may cancel SMS messages at any time by replying STOP to the number that sent the message. You may also use another reasonable method that clearly communicates your request to stop receiving messages. VisiTel may send one final message confirming that your request was processed.
  • Help: Reply HELP for assistance, or email support@ctel.us.
  • Message and data rates: Message and data rates may apply to messages sent to you or received from you. Contact your wireless provider with questions about your text or data plan.
  • Mobile carriers: Wireless carriers are not liable for delayed or undelivered messages.

Your privacy is important to us. This policy explains the principles VisiTel follows when collecting, using, retaining, and protecting personal information.

Mobile information: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties. Your consent to receive SMS messages is used for communications between you and VisiTel as described in these terms.
